These Terms of Service (the “Terms”) are a binding agreement between you (“you” or the “Customer”) and Traffic One Labs (“Traffic One”, “we”, “us”, or “our”). They govern your access to and use of the Traffic One plugin, the Traffic One Cloud platform, our command-line and Model Context Protocol (MCP) integrations, our websites, the Library, the Dashboard, and any related products, content, and services we make available (together, the “Services”).
By installing the plugin, creating an account, clicking “I agree,” or otherwise accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. If you are using the Services on behalf of an organization, you represent that you are authorized to bind that organization, and “you” refers to that organization.
01The Services
Traffic One provides, in summary:
- The plugin. A plugin layer for AI coding agents and editors (such as Cursor, Claude Code, Codex, GitHub Copilot, Kilo, Windsurf, and OpenCode) that adds engineering rules, security defaults, architecture constraints, documentation, and deployment workflows to AI-assisted development.
- The Library. A catalogue of versioned Rules and Skills that the plugin applies, together with documentation describing how they work.
- Traffic One Cloud. Optional managed infrastructure for deploying and running applications, which may include edge functions, containers, managed databases, object storage, background job queues, secrets management, networking, DNS, TLS, CDN, and one-command deploys and rollbacks.
- Accounts & Dashboard. Account registration, workspaces and teams, project management, API keys, webhooks, usage metering, billing, and related administrative tools.
- Websites & communications. Our marketing site, pricing pages, early-access and waitlist flows, and product communications.
The Services are under active development. We may add, change, suspend, or discontinue features at any time. Where a change materially reduces core functionality of a paid Service, we will use commercially reasonable efforts to give advance notice.
02The open-source plugin and its license
The Traffic One plugin and the Rules and Skills in the Library are made available as open-source software under the MIT License, except where a component is expressly marked with a different license. To the extent of any conflict between these Terms and the applicable open-source license with respect to your use of that open-source software, the open-source license governs.
Open-source components are provided “as is” without warranty, as stated in their license. These Terms continue to govern the hosted Services (including Traffic One Cloud, accounts, and the Dashboard), which are not open source.
03Accounts, eligibility, and security
Some Services require an account. You may register using email (including magic-link sign-in) or supported third-party identity providers such as GitHub or Google. You agree to provide accurate information and to keep it current.
- You must be at least 16 years old (or the age of digital consent in your jurisdiction) and capable of forming a binding contract.
- You are responsible for all activity under your account and for maintaining the confidentiality of your credentials, API keys, and tokens. We strongly recommend enabling two-factor authentication where available.
- You must notify us promptly at hi@traffic.io of any unauthorized use of your account or other security incident.
- Workspace and team administrators may control access, roles, and data within their workspace and may be able to view or manage members’ activity in that workspace.
04Acceptable use
You agree not to use the Services to:
- violate any law, regulation, or third-party right, including intellectual property, privacy, and export-control laws;
- deploy or distribute malware, run phishing, send spam, or engage in fraud, abuse, or deceptive practices;
- attempt to gain unauthorized access to, probe, or disrupt the Services or any network, system, or account, or circumvent usage limits, billing, or security controls;
- host or transmit content that is unlawful, infringing, or that you do not have the right to host or transmit;
- reverse engineer, resell, or use the non-open-source Services to build a competing service, except to the extent this restriction is prohibited by law;
- use the Services to generate or operate workloads that impose an unreasonable or disproportionately large load on our infrastructure, or that mine cryptocurrency except where we have expressly permitted it; or
- use the Services in a manner that infringes, misappropriates, or otherwise violates the rights of others, including through AI-generated output.
We may investigate suspected violations and may suspend or terminate access, remove content, or throttle resources to protect the Services, our users, or third parties. Where practicable and lawful, we will give you notice.
05Your content and customer data
Your content. You retain all rights to the source code, data, applications, and other materials you create, upload, deploy, or transmit through the Services (“Customer Data”). We do not claim ownership of Customer Data or of the code you generate with the plugin.
License to operate. You grant Traffic One a worldwide, non-exclusive license to host, store, process, transmit, display, and otherwise use Customer Data solely as necessary to provide, secure, maintain, and improve the Services, to prevent or address technical or security issues, and as you instruct through your use of the Services. This license ends when Customer Data is deleted, except for residual backups retained for a limited period and anonymized or aggregated data.
Responsibility. You are responsible for your Customer Data, for having the necessary rights and consents to provide it, and for complying with all laws applicable to it. You are responsible for maintaining your own backups; while we may keep backups, we do not guarantee they will be available or complete.
AI-generated output. The plugin assists in producing code and other output. AI systems can make mistakes and may produce output that is inaccurate, insecure, or that resembles existing works. You are responsible for reviewing, testing, and validating all output before relying on it or deploying it to production. We make no warranty that output is correct, secure, fit for any purpose, or free of third-party rights.
06Third-party services and integrations
The Services interoperate with, or rely on, third-party products — for example AI editors and agents, cloud and edge infrastructure providers, managed database providers (such as Supabase), email delivery providers (such as Resend), identity providers (such as GitHub and Google), and the AI models you connect. Your use of those products is governed by their own terms, and we are not responsible for them. You are responsible for obtaining and complying with any third-party accounts, licenses, or API keys you connect to the Services.
07Plans, fees, and usage-based billing
Paid Services are offered under the plans described on our pricing page, which may include a Free tier, Hobby, Pro, and Enterprise plans. Plans combine a recurring fee and/or included credits with usage-based billing for the resources your workloads consume (such as compute, memory, storage, egress, and object storage), metered at the rates published on our pricing page or in your order form.
- Credits and overages. Included credits are applied against eligible usage. Usage beyond your included credits is billed at the published rates. Credits are not redeemable for cash and expire as described at the point of purchase or on the pricing page.
- Billing cycle. Recurring fees are billed in advance and usage charges in arrears, on the cycle shown at checkout (typically monthly, or annually where offered). Fees are stated exclusive of taxes; you are responsible for applicable taxes.
- Payment. You authorize us and our payment processors to charge your designated payment method for all amounts due. If a charge fails, we may retry and may suspend or limit paid Services until amounts are paid.
- Spending controls. Where we offer spending caps or limits, they are provided to help you manage costs but are estimates; you remain responsible for usage actually incurred.
- Changes to pricing. We may change prices and plan inclusions. For recurring fees, changes apply from your next renewal; we will use reasonable efforts to notify you in advance.
- Refunds. Except where required by law or expressly stated, fees and usage charges are non-refundable.
The Free tier and any trial credits are provided as-is and may be modified or withdrawn. We may impose reasonable resource limits and fair-use restrictions on any plan.
08Our intellectual property
Other than the open-source components and your Customer Data, the Services — including Traffic One Cloud, the Dashboard, our websites, designs, text, graphics, the “Traffic One” name, logos, and other brand features — are owned by Traffic One Labs or our licensors and are protected by intellectual property laws. Except for the rights expressly granted in these Terms (and the open-source license), no rights are granted to you. You may not use our brand features without our prior written permission.
Feedback. If you give us suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction or obligation to you.
09Privacy
Our Privacy Policy and Cookie Policy describe how we collect and process personal data. By using the Services, you acknowledge those policies. Where we process Customer Data that contains personal data on your behalf, we do so as your processor and, where required, under a data processing agreement.
10Service availability and beta features
We aim to keep the Services available and reliable but do not guarantee uninterrupted or error-free operation. The Services may be unavailable during maintenance, updates, or circumstances beyond our control. Any service-level commitments apply only if expressly stated in a separate written agreement or order form.
Features labelled beta, preview, early-access, or experimental are provided for evaluation, may be changed or removed at any time, and are excluded from any availability or support commitments.
11Suspension and termination
You may stop using the Services and close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, to protect the Services or others, or for prolonged non-payment.
On termination, your right to use the Services ends and we may delete Customer Data after a reasonable period. Provisions that by their nature should survive — including ownership, disclaimers, limitations of liability, indemnification, and dispute terms — survive termination. Where you terminate a paid plan, you remain responsible for charges incurred through the effective date of termination.
12Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT AND OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY OUTPUT WILL BE ACCURATE, SECURE, OR FIT FOR YOUR PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
13Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER TRAFFIC ONE LABS NOR ITS SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITATIONS APPLY TO ALL THEORIES OF LIABILITY AND FORM AN ESSENTIAL BASIS OF THE AGREEMENT BETWEEN US.
14Indemnification
You will defend, indemnify, and hold harmless Traffic One Labs and its officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your Customer Data, your use of the Services, your deployed applications, or your breach of these Terms or violation of any law or third-party right.
15Governing law and disputes
These Terms are governed by the laws of [Governing jurisdiction — to be completed by Traffic One Labs], without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the courts located in that jurisdiction, except that either party may seek injunctive relief in any competent court. If any provision is held unenforceable, the remaining provisions remain in effect.
16Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
